2. CORE CONDITION: THE PRE-INSPECTION & PRE-CUT RULE
2.1 CRITICAL NOTICE: All goods must be fully unpacked, laid flat, and thoroughly inspected for colour, shading, batch matches, visual defects, damages, or measurement discrepancies PRIOR to cutting, altering, or commencing installation.
2.2 Once a carpet, vinyl, laminate, LVT, underlay, or any other flooring product has been cut, shaped, glued, nailed, or fitted in any manner, the goods shall be deemed accepted by the buyer.
2.3 Luxury Floors Ltd will accept absolutely no liability, returns, refunds, or replacement claims for visual defects, incorrect sizing, shading variations, or batch mismatches once the material has been cut or installation has begun.
3. FITTER CHARGES & DELAYED DELIVERIES
3.1 IMPORTANT: We strongly advise all customers NOT to book independent carpet fitters, floor layers, or joiners until the goods have been successfully delivered to the site, unpacked, and verified to be complete and correct.
3.2 All delivery dates and time frames provided on our website or via email are good-faith estimates only and do not constitute a legal guarantee of delivery time.
3.3 Luxury Floors Ltd shall not be held liable under any circumstances for third-party professional fees, wasted fitter day-rates, cancellation penalties, project delay expenses, or loss of commercial earnings resulting from late, delayed, damaged, or incomplete deliveries.
4. CONTRACT FORMATION AND STOCK VERIFICATION
4.1 The display of products on tcctradefloors.co.uk constitutes an "invitation to treat" and not a binding legal offer. Your order submission represents an offer to purchase goods.
4.2 A legally binding contract is only formed when we dispatch the goods from our warehouse or trade counter and issue a shipment confirmation email.
4.3 We reserve the absolute right to cancel or refuse any order at our discretion prior to dispatch (including but not limited to instances of stock errors, pricing errors, or delivery logistical barriers). In such instances, a full refund of any monies paid will be promptly issued.
5. PRICE AND PAYMENT
5.1 Prices displayed on our website are shown both exclusive and inclusive of VAT where applicable, unless explicitly stated otherwise. Delivery costs are calculated and added at checkout.
5.2 While we try to ensure all pricing on tcctradefloors.co.uk is completely accurate, errors may occasionally occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.
5.3 Payment must be made in full via our secure online checkout using approved credit/debit cards or alternative digital payment gateways before any goods are prepared, cut, or dispatched.
6. DELIVERY CONDITIONS
6.1 Unless explicitly upgraded or agreed otherwise in writing, all deliveries are strictly Curbside Only.
6.2 Delivery drivers are not insured to carry heavy rolls of carpet, heavy boxes of LVT, or pallets into your property, up flights of stairs, or past the main entrance threshold. It is the customer's sole responsibility to ensure adequate physical assistance is on-site to safely handle and move the goods from the delivery vehicle.
6.3 Inspection Window: Trade Customers must inspect goods upon delivery and note any obvious external transport damage or shortages on the driver's delivery note. All hidden shortages, missing items, or transit damage claims must be reported to our customer service desk in writing within 48 hours of delivery. Failure to report within this window will invalidate claims.
7. CANCELLATIONS, RETURNS & RESTOCKING FEES
7.1 Bespoke and Custom Cut Goods: In accordance with UK consumer law, any goods that are cut-to-size or custom-tailored to your specified dimensions (including but not limited to carpets, vinyls, and artificial turf cut from a master roll) are exempt from standard cooling-off cancellation rights. Once cutting has commenced, these orders cannot be cancelled, amended, or returned.
7.2 Standard Unopened Items (Consumers): Retail Consumers have a statutory right under Consumer Contracts Regulations to cancel standard, non-custom stock items (such as unopened full boxes of underlay, scotia, or flooring trims) within 14 days of delivery. The consumer is responsible for paying all return freight costs.
7.3 Trade Customer Returns: Returns on standard non-cut stock items from commercial Trade Customers are handled purely at our discretion. Approved trade returns are subject to a 20% restocking and handling fee, and items must be in pristine, resalable, unopened original packaging.
8. RETENTION OF TITLE
8.1 Legal ownership and title of all flooring products and accessories shall remain strictly with Luxury Floors Ltd and shall not pass to the buyer until we have received cleared payment in full for the goods, including all applicable delivery fees.
9. LIMITATION OF LIABILITY
9.1 Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.
9.2 Commercial Trade Customers: Our total aggregate liability to any Trade Customer for any claim arising out of or in connection with a contract, whether in contract, tort (including negligence), or breach of statutory duty, shall be strictly limited to the net invoice price paid for the specific goods giving rise to the claim.
9.3 We shall explicitly not be liable to any business or trade entity for any indirect, special, or consequential losses, including but not limited to loss of profit, loss of business opportunity, reputational damage, or third-party contractual penalties.
10. GOVERNING LAW
10.1 These terms and conditions, and any disputes arising out of or in connection with them, shall be governed by and construed exclusively in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
11. All Items and Special Offers
11.1 All items and Special Offers are subject to availability. We reserve the absolute right to cancel or refuse any order at our discretion prior to dispatch or collection (including but not limited to instances of stock errors, pricing errors, or delivery logistical barriers). In such instances, a full refund of any monies paid will be promptly issued.
11.2 Any offer can be claimed at one time with one order value.
11.3 Order values from the promotions do not qualify for promotions.
11.4 Promotional Offers do no qualify for order values.

12. Delivery Charges
12.1 We keep our delivery rates straightforward:

Orders over £416.01 (ex. VAT) / £500 (inc. VAT): Free delivery!
12.2. Regional Coverage & System Limits
Our network covers mainland logistics pathways across England, Scotland, and Wales. However, restricted dispatch areas exist where third-party couriers cannot navigate. To protect you from accidental cross-border handling fees, our digital checkout automatically flags unsupported postcodes and holds the transaction prior to payment processing.
12.3. Delivery Windows & Notifications
Schedule: Transit teams operate exclusively on weekdays between 07:30 and 18:00. We do not coordinate shipments over Bank Holidays.
Time slots: Specific arrival times cannot be pre-arranged or locked in.
Tracking Alerts: Providing a valid mobile number routes your profile into an automated tracking network. While our carriers push interactive route alerts on the morning of dispatch, this live-tracking asset relies on digital network availability and is not explicitly guaranteed.
12.4. Heavy Freight Access (18.5T Logistics)
Our primary fleet consists of heavy 18.5-tonne commercial lorries. Your drop-off destination must comfortably accommodate vehicles of this size. You are required to register localized spatial barriers during order entry, including:

12.5. Disposal of Shipping Materials
To protect heavy LVT or wood pallets during transport, orders are bundled using industrial timber skids. Once unstrapped on-site, the recipient assumes full ownership and legal disposal responsibility for all wooden pallets and packaging trash.
12.6. Drop-Off Discretion & Risk Transfer
We strongly urge you to have an authorized agent on-site to inspect the arrival. If you verbally direct a driver to drop freight in an unattended space, they may do so only if they judge the zone to be secure. The instant items touch the ground, title and physical risk shift to the buyer; TCC trade floors waives all liability for subsequent weather wear, site damage, or theft.
12.7. Kerbside Offloading Policy
For insurance validation and worker safety, all drops are restricted strictly to kerbside placement. Vehicles will park at the nearest safe asphalt boundary to discharge cargo. Fleet drivers are legally prohibited from crossing property lines or carrying heavy bundles inside structures.
12.8. Site Labor Requirements & Aborted Shipments
Commercial vinyl, trade carpets, and bulk underlayment require physical effort to handle safely.
Crew Requirements: We require a minimum of two able-bodied personnel present at the delivery location to receive your order.
Driver Requests: Crew members are expected to assist the driver with physical unloading if requested.
Failed Logistics: If an arrival is turned away because your site lacks proper lifting support, it will trigger an automated redelivery invoice, or require self-collection from your nearest regional freight depot.
12.9. Mobile Comm Links & Failed Contact
Please monitor your phone lines continuously on your scheduled delivery date. Couriers attempt a courtesy call from the cab roughly 30 minutes before arrival to confirm you are on-site and ready to guide them in. Because drivers have rigid schedules, they will not wait out unanswered lines or leave voicemails. If they cannot reach you, they will move on, resulting in an automated redelivery charge.
12.10. Failed Site Visits & Gate Fees
If an operator aborts an arrival due to poor site conditions, security blocks, or absence, a secondary delivery surcharge will be issued before a second run is scheduled. Alternatively, goods can be claimed at the local carrier warehouse.
12.11. Smart Contracting & Project Timelines
While we keep high stock volumes at our Hayes Depot, unexpected road delays can still happen. We highly recommend that you do not schedule installers, fitters, or contractors until your materials have arrived on-site and been verified. TCC trade floors accepts no liability for third-party labor costs, lost commercial hours, or sequential project overruns caused by transport delays.
12.12. External Freight Inspections
Our stock leaves our facilities in perfect, undamaged condition. While we don't expect you to unroll entire flooring lengths on the pavement, you must review the exterior packaging for damage before signing the paperwork.
Visible Claims: We cannot process compensation for clear external tears, crushed boxes, or missing items once the driver has left the premises.
Right to Refuse: If cargo arrives heavily compromised, you have the right to reject the delivery.
Incorrect Claims: Items returned under damage claims that are later verified as perfect will have round-trip transport expenses billed back to the buyer's trade account.
12.13. Pre-Cut Materials Check
Before applying adhesives, cutting rolls, or starting installation, the fitter or site manager must verify that the product match, dye lot, and sizing are perfect. Once a roll is cut or laid down, we cannot accept manufacturing fault claims. Defect reviews post-installation often involve independent evaluations and cause major project delays.
12.14. Dispatch Address Responsibility
Shipments move strictly to the location entry logged on your trade invoice. Accurate addresses are your responsibility. We hold no liability for misrouted goods once they are signed off at the delivery coordinates you provided.
12.15. Estimated Dispatch Frames
Time is not contractually binding ("time is not of the essence"). Target dispatch windows are calculated as helpful estimates. TCC trade floors protects its buyers from upfront pricing inflation but cannot absorb financial costs linked to logistical or supplier holdups.
12.16. Property Rights & Security Transfer
Legal ownership of the items passes to the buyer the moment they are unloaded at your specified location. Past this threshold, asset security falls completely on the purchaser.
12.17. Trade Boundaries & Freight Restrictions
We cater strictly to entities, companies, and professional contractors registered and trading inside the United Kingdom.
Forwarding: We do not deliver to international freight-forwarding yards.
Warranty Rules: We hold zero liability for cross-border shipping or export documentation, and all backing manufacturer warranties apply exclusively inside mainland UK borders.
